1) Agreement to These Terms

By accessing or using the Service, you agree to these Terms and confirm that you've read and understood them. If you do not agree, do not use the Service.

We may update these Terms from time to time. The "Last updated" date reflects the most recent revision. Your continued use of the Service after changes take effect means you accept the updated Terms.

2) Adult Content Warning + Eligibility

The Service contains explicit adult content and is intended only for adults.

You may use the Service only if:

• You are at least 18 years old (or the age of majority where you live—whichever is higher), and
• It is legal for you to view adult content in your location, and
• You are using the Service in compliance with all applicable laws and regulations.

You are responsible for ensuring your access is lawful in your jurisdiction.

3) Accounts, Security, and Responsibility

To access certain features, you may need an account. You agree to:

• Provide accurate information and keep it up to date.
• Keep your login credentials secure.
• Be responsible for all activity under your account (whether or not you authorized it).
• Notify us promptly if you suspect unauthorized access.

We may suspend or terminate accounts as described in these Terms and in our Content Rules.

4) Incorporated Policies (Cohesion Across Pages)

The following policies are incorporated by reference and form part of these Terms:

• Cookie Policy
• Statement on AI

If there is a conflict between these Terms and the Content Rules, these Terms control, unless we explicitly state otherwise.

5) Your Content (Ownership + License You Grant Kylee)

5.1 Ownership

You keep ownership of the content you upload or post ("User Content").

5.2 License to Kylee

By uploading User Content, you grant Kylee Labs a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:

• host, store, cache, reproduce, display, publish, distribute, and transmit your User Content,
• create technical modifications (e.g., resizing, formatting, compression) to operate and improve the Service,
• promote the Service (including using previews/thumbnails and excerpts),

solely in connection with operating, developing, marketing, and providing the Service and related features.

This license continues for as long as your User Content remains on the Service, plus a reasonable period afterward for backups, audits, legal compliance, and dispute resolution.

5.3 You promise you have the rights

You represent and warrant that:

• you own your User Content or have all necessary permissions to upload it, and
• your User Content does not violate law, third-party rights, or the Content Rules.

5.4 Feedback

If you send suggestions or feedback, you grant us a license to use it without restriction or compensation.

6) Content Standards, Moderation, and Enforcement

6.1 Pre-publication review

We may review content before it becomes publicly visible to check compliance with law, these Terms, and the Content Rules. We may use automated tools to assist moderation, but moderation actions may involve human review.

6.2 We can remove or restrict content

We may refuse, limit, remove, or restrict content or accounts at any time if we believe it violates these Terms, the Content Rules, or applicable law—or if needed to protect users, comply with payment processors, or reduce risk.

6.3 Reporting

Users may report content through in-product reporting tools (if available) or by emailing support@kylee.io. We review reports within a commercially reasonable timeframe.

6.4 Appeals

Where feasible, creators may appeal certain moderation decisions by contacting support@kylee.io within 14 days of the decision. Appeals may be reviewed by a different moderator or reviewer.

6.5 Verification / KYC

To protect the community and comply with legal and payment-processor requirements, we may require age and identity verification (KYC) for creators who upload and/or monetize content. Failure to complete verification may result in restrictions, removal, or inability to monetize.

7) Prohibited Content and Conduct (High-Level Summary)

You may not use the Service to create, upload, share, or promote content that violates the Content Rules or law. This includes, without limitation:

• Any depiction involving minors or characters who are under 18, or appear under 18 (all characters must be 18+ in age and appearance).
• Non-consensual sexual content, coercion, exploitation, trafficking, or solicitation.
• Sexual violence, extreme violence, or gore intended to shock or degrade (see Content Rules for specifics).
• Incest, bestiality, or other illegal content.
• Doxxing, invasion of privacy, or sharing personal info without consent.
• Content that infringes copyrights, trademarks, or publicity/likeness rights.
• Harassment, threats, hate content, or targeted abuse.
• Malware, phishing, credential theft, or attempts to bypass security.
• Scraping, harvesting, or automated access except as expressly allowed (including respecting robots.txt where applicable).
• Impersonation, fraud, or misleading users (including misrepresenting authorship).

The Content Rules contain the detailed, controlling version of what's allowed and what's not.

8) AI-Assisted vs. AI-Generated Content

Kylee.io is primarily for human-made artwork. AI-assisted editing is permitted where the human creator remains the primary author (e.g., cleanup, denoise, upscaling, minor inpainting fixes). Content that is mostly or fully AI-generated is not permitted on the main platform at this time.

Misrepresenting mostly/fully AI-generated content as human-made may result in removal or account action. We may introduce required labeling and/or a separate area for AI-generated content in the future.

9) Live-Action, Real-Person Depictions, and External Links

Kylee is primarily an illustrated/digital art platform and is not intended for hosting live-action adult photos or videos. We may restrict or prohibit live-action content as described in the Content Rules.

Depictions of identifiable real people (including celebrities or private individuals) may be restricted or prohibited under the Content Rules, especially where consent, rights, or safety concerns apply.

The Service may allow links to third-party sites. We do not control third-party sites and are not responsible for their content, policies, or practices.

10) Monetization, Payments, Taxes, and Chargebacks

If you use monetization features (now or in the future), you agree that:

• Payments may be processed by third-party payment processors and their terms apply.
• We and/or processors may hold funds, apply reserves, delays, minimum payout thresholds, or fees to manage fraud/risk and comply with law.
• You are responsible for all taxes related to your earnings.
• We may reverse, hold, or recover payouts if we suspect fraud, unlawful activity, chargebacks, or policy violations.
• Refunds (if applicable), payout timing, and monetization eligibility may be described in additional monetization terms, product pages, or creator dashboards.

11) Intellectual Property + DMCA

11.1 Our IP

The Service, including branding, design, software, and features, is owned by Kylee Labs or its licensors and is protected by intellectual property laws.

11.2 Copyright complaints (DMCA)

If you believe content infringes your copyright, email legal@kylee.io with:

• your contact information,
• identification of the copyrighted work,
• identification of the allegedly infringing material and its location (URL),
• a statement of good-faith belief,
• a statement under penalty of perjury that the information is accurate and you're authorized to act, and
• your physical or electronic signature.

We may remove content and may terminate accounts of repeat infringers where appropriate.

12) Service Availability and Changes

We may modify, suspend, or discontinue all or part of the Service at any time. We are not liable for any impact this may have, including loss of access to content, features, or monetization—subject to applicable law.

13) Disclaimers

To the fullest extent permitted by law:

• The Service is provided "as is" and "as available."
• We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
• We do not guarantee that the Service will be uninterrupted, error-free, or secure.
• We do not endorse User Content and are not responsible for User Content or user conduct.

14) Limitation of Liability

To the fullest extent permitted by law, Kylee Labs will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, loss of data, or loss of goodwill, arising out of or related to your use of the Service.

Our total liability for all claims related to the Service will not exceed the greater of:

• USD $100, or
• the amount you paid to Kylee Labs (if any) in the 12 months before the claim arose.

15) Indemnification

You agree to indemnify, defend, and hold harmless Kylee Labs and its directors, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from:

• your use of the Service,
• your User Content,
• your violation of these Terms or the Content Rules, or
• your violation of any law or third-party right.

16) Termination, Account Deletion, and Data Retention

You may request account deletion where available. We may retain certain data for:

• backups and disaster recovery,
• legal compliance,
• fraud prevention and safety,
• dispute resolution and enforcement.

We may suspend or terminate your access at any time if we believe you violated these Terms, the Content Rules, or applicable law, or if needed to protect users, the platform, or comply with processor/legal requirements.

17) Governing Law and Venue

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law rules.

You agree to exclusive jurisdiction and venue in the state and federal courts located in Delaware, except where applicable law requires otherwise.

18) Miscellaneous

• Severability: If any provision is unenforceable, the rest remains in effect.
• No waiver: Failure to enforce a provision is not a waiver.
• Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Entire agreement: These Terms and incorporated policies are the entire agreement regarding the Service.
